Public inquiries and appeals

  • An objection or environmental representation will usually result in a public inquiry.
  • Applicant and objector/representer can present their cases.
  • Legal representation is permitted.
  • Public may only be excluded where the objection concerns the applicant’s financial resources.
  • Appeals against a Traffic Commissioner decision go to the Upper Tribunal.
  • Appeal deadline: 28 days from publication of the decision.
  • Environmental representers cannot start an appeal themselves, but may join an appeal.
  • Further appeals go to:
    • Court of Appeal in England and Wales.
    • Court of Session in Scotland.
