7. CONTRACTED OUT MAINTENANCE

  • Maintenance may be contracted to commercial agents/contractors; contract hire can also include maintenance.
  • A detailed written contract is required when an outside contractor maintains the vehicles.
  • The model contract requires the contractor to inspect specified items, complete maintenance records and provide copies to the operator.
  • The operator must submit vehicles at agreed intervals and pay for the work.
  • Contracting out the physical work does not transfer ultimate responsibility: the operator remains responsible for roadworthiness and maintenance records.
