12. Conduct and Disciplinary Matters

  • Traffic Commissioners have a fundamental role in maintaining the conduct and fitness of vocational licence holders.
  • They can investigate the conduct of existing vocational drivers and applicants.
  • They consider relevant convictions and other factors.
  • Convictions are not limited to LGV offences; ordinary driving offences can also be considered.
  • If a vocational licence holder is disqualified from holding an ordinary driving licence, the driver is automatically disqualified from driving larger goods vehicles.
  • Traffic Commissioners can issue warning letters.
  • They can require a driver to attend a hearing.
  • They can recommend suspension or revocation of vocational entitlement.
  • Vocational entitlement may be suspended for a specified period or revoked indefinitely.
  • Appeals against suspension or revocation can be made to a magistrates' court in England and Wales or a sheriff's court in Scotland.
  • Revocation remains in force while an appeal is being considered.
